The legal issues surrounding the fuel spill into Lemon Creek in the Slocan Valley two summers ago have become more complicated.
Executive Flight Centre – the company that supplied fuel to fire-fighting helicopters – is now taking action.
Court documents show it is suing the province saying it did not properly maintain, manage or monitor Lemon Creek Road.
They also claim Transwest Helicopters did not place proper signage.
In July 2013 their fuel tanker tumbled into the creek when the road gave way spilling 33,000 litres of fuel .
The province is already being sued by a private citizen under the Fisheries Act.
And the province is suing Executive Flight Centre to cover costs associated with a class action claim by local residents.
