Nelson property case reaches Supreme Court of Canada

A Nelson property dispute has reached the Supreme Court of Canada.

The case involves a piece of lakeside land on Beatty St.

Earl and Geri Mowatt argue they own it based on the principle of adverse possession.

It’s been occupied by squatters since at least 1909.

But the city says it’s public road allowance.

The Mowatts lost their case in BC Supreme Court but won in the Court of Appeal.

The Supreme Court of Canada agreed to hear the case and lawyers presented evidence last week.

Judgement has been reserved.
