Private prosecution sought in Lemon Creek fuel spill

A frustrated Slocan Valley resident is taking legal action after last year’s aviation fuel spill into Lemon Creek because she says the province has failed to do so.

Long time environmental activist Marilyn Burgoon is seeking what’s known as a private prosecution against Executive Flight Centre. They’re the company responsible for the tanker that tumbled into the creek in July 2013 dumping 33,000 litres of fuel.

She says she has a duty to stand up for the environment.


She says her lawyer will argue that the huge spill was most certainly a violation under the law, fish were killed and the province should be laying charges.

She does not want the incident to be written off by government as just a bad accident.
