Local wins right to press charges for Lemon Creek fuel spill

A local citizen and well-known environmental activist is calling it an important victory for democracy.

The Slocan Valley’s Marilyn Burgoon has won her right as a private citizen to see the company at the heart of last year’s Lemon Creek fuel spill, as well as the province, face charges in court.

Her lawyers have satisfied a judge that there’s enough evidence to bring Executive Flight Fuel Services and the Ministry of Environment to court to face charges under the Fisheries Act.

Fish were killed and the environment was damaged.

Burgoon says there should have been better signage for the tanker that ultimately spilled 33,000 litres of fuel into Lemon Creek on its way to a helicopter staging area.

She says using a pilot vehicle would also have made sense.
